With regard to AI and it training on the Internet and the content there being fair game - regarding the author’s lawsuit - @Leo and the others have posted the content themselves or have given their permission to publish that content.

In the case of the author, if the AI has indeed read the whole book, it has probably done so from an “illegal” source - i.e. the AI engine scoured the web and came across a site that illegally published a copy of the book, in contravention of the author’s/publisher’s copyright. In that case, the AI should have ignored all content on such sites. This is a failure of the people defining the training material.

Two wrongs don’t make a right. If the information is not legally available, the AI trainer should remove it from the list of material the AI is trained on.

I wanted to point out that it is not true that Johnny Cash died before “Barbie Girl” by Aqua was release. “Barbie Girl” was released in 1997 and Johnny Cash passed away in 2003. It is plausible that Johnny Cash could have put out a cover of “Barbie Girl” before he died. After all, Mr. Cash was an active artist up to when he died.
